Terms of Service
Effective date: 28 April 2026
These Terms of Service (the "Terms") govern your use of QuantStream — our marketing site, public API, and dashboard (together, the "Service"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are
The Service is operated by:
Jakub Krupski 51-649 Wrocław, Poland Email: contact@quantposition.com
In these Terms "we", "us", and "our" refer to the operator above. "You" means the person or entity using the Service.
2. Eligibility
You may use the Service only if you:
- are at least 16 years old and have the legal capacity to enter into a binding contract,
- are not located in, or a resident of, any country or territory subject to comprehensive trade sanctions of the European Union, United States, or United Nations, and are not on any sanctions or denied-parties list,
- have not been previously banned, suspended, or removed from the Service by us.
If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation, and "you" includes both you and that organisation.
3. The Service
QuantStream aggregates financial news from multiple data providers and uses artificial-intelligence models to produce summaries, sentiment scores, and related metadata. The Service is offered through a web app and a public API authenticated with API keys.
The Service is provided for informational purposes only.
4. Account and API keys
To use most features you must create an account. You agree to:
- provide accurate and current information at sign-up and keep it up to date,
- maintain only one account per person,
- keep your password and API keys confidential,
- accept responsibility for all activity under your account or API keys, whether or not authorised by you,
- notify us promptly at contact@quantposition.com of any suspected unauthorised use.
API keys are personal to your account. You may not share, resell, sublicense, or transfer them.
5. Acceptable use
You must not, and must not attempt to:
- use the Service for any illegal, fraudulent, or harmful purpose,
- scrape, crawl, or bulk-extract content beyond what is offered through the documented API,
- circumvent, disable, or otherwise interfere with rate limits, quotas, authentication, or other protective measures,
- reverse-engineer, decompile, or attempt to derive the source code, models, or training data behind the Service,
- resell, redistribute, sublicense, or build a competing product on top of the Service or its outputs without our prior written permission,
- upload or transmit malware, exploits, or any content that infringes the intellectual-property rights of others,
- use the Service to harass others, generate misleading content, or manipulate markets,
- attempt to access accounts, data, or infrastructure that are not yours,
- use automated systems to interact with the Service in a way that imposes an unreasonable load on our infrastructure.
We may investigate suspected violations and cooperate with law-enforcement authorities.
6. No financial, investment, tax, or legal advice
The Service is for informational and educational purposes only. We are not a broker-dealer, investment adviser, financial planner, tax adviser, or law firm, and nothing the Service produces — including AI-generated summaries, sentiment scores, signals, or any other output — is investment advice, a recommendation to buy or sell any security, or any other form of professional advice.
Trading and investing involve substantial risk of loss. You are solely responsible for any decision you take based on information from the Service, and you should consult a licensed professional before making any financial decision.
7. Service availability and changes
The Service is provided "as is" and "as available". We may at any time, in our sole discretion and with or without notice:
- add, modify, suspend, or discontinue any feature, endpoint, model, rate limit, or pricing tier,
- perform maintenance that interrupts the Service,
- impose new restrictions on use of the Service.
We do not guarantee uptime, latency, accuracy of outputs, or availability of any specific feature. Beta or experimental features may be removed at any time.
8. Suspension and termination
We may suspend, restrict, or terminate your access to the Service, your account, or any of your API keys at any time, for any reason or no reason, with or without prior notice, in our sole discretion. Reasons may include, without limitation, actual or suspected violation of these Terms, abuse of the Service, risk to other users or to us, a legal or regulatory request, or discontinuation of the Service.
Upon termination:
- your right to access and use the Service ends immediately,
- we may delete your account, content, and API keys,
- sections that by their nature should survive — including 5 (Acceptable use), 9 (Intellectual property), 11 (Disclaimers), 12 (Limitation of liability), 13 (Indemnification), 17 (Governing law), and 19 (Severability and entire agreement) — survive termination.
You may close your account at any time by writing to contact@quantposition.com.
9. Intellectual property
We and our licensors own all rights, title, and interest in and to the Service, including all software, models, prompts, content, designs, logos, and trademarks. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal use during the term of these Terms.
You retain ownership of content you submit to the Service (for example, queries, prompts, and configuration). You grant us a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, and process that content as needed to operate, secure, and improve the Service.
The Service may produce or expose content from third parties (for example, news headlines or article summaries). Such third-party content remains the property of its owners and is provided to you under fair-use, licence, or similar legal grounds; you must not reuse it in a way that exceeds those grounds.
10. Third-party services
The Service depends on third-party providers — including, without limitation, hosting (Vercel, Render), analytics (Google), email delivery, news data providers, and AI model vendors. These are independent third parties; their acts, fees, terms, outages, and privacy practices are not under our control. Your use of any third-party service is subject to that provider's own terms.
11. Disclaimers
To the maximum extent permitted by applicable law:
- the Service is provided "as is" and "as available", with all faults and without warranties of any kind, whether express, implied, statutory, or otherwise,
- we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, security, uninterrupted operation, freedom from errors or harmful components, and that AI or news outputs are correct, unbiased, or up to date,
- no information from the Service creates any warranty that is not expressly stated in these Terms.
12. Limitation of liability
To the maximum extent permitted by applicable law:
- in no event will we be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or trading opportunities, even if we have been advised of the possibility of such damages,
- our aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you have paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred euros (EUR 100).
Carve-out. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including, where applicable, liability for gross negligence, wilful misconduct, death or personal injury caused by negligence, or under mandatory consumer-protection rules. If you are an EU consumer, your statutory rights under the law of your country of residence are not affected by this section.
13. Indemnification
To the maximum extent permitted by applicable law, you will defend, indemnify, and hold us (and our officers, employees, contractors, and licensors) harmless from any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising out of or related to:
- your use of the Service,
- any content you submit to the Service,
- your violation of these Terms or of any law or third-party right,
- the actions or omissions of anyone using your account or API keys.
14. Force majeure
We will not be liable for any delay or failure to perform caused by an event beyond our reasonable control — including outages of upstream providers, internet or power failures, natural events, pandemics, strikes, war, civil unrest, or governmental action.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Effective date" at the top and, for material changes, send a notice to the email address on your account. Continued use of the Service after the change takes effect means you accept the updated Terms. If you do not accept them, you must stop using the Service.
16. Privacy
Our handling of personal data is described in our Privacy Policy, which is part of these Terms by reference.
17. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Poland, without regard to conflict-of-laws rules. The courts of Wrocław, Poland have exclusive jurisdiction to hear any dispute arising out of or relating to these Terms or the Service.
If you are an EU consumer, the previous paragraph does not deprive you of the protection of mandatory rules of the law of your country of residence, nor of your right to bring proceedings before, or to be sued in, the courts of that country.
18. Consumer rights
Nothing in these Terms is intended to limit or exclude any statutory consumer rights you may have under the laws of your country of residence that cannot be limited or excluded by contract.
19. Severability and entire agreement
If any provision of these Terms is held to be unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements on the same subject.
We may assign these Terms (in whole or in part) to a successor or affiliate without your consent. You may not assign your rights or obligations under these Terms without our prior written consent.
